Seminar on Sexual Harassment at Workplace, First Aid, and the New Labor Code

Organized by Indian Council of Industrial Management (ICIM) in collaboration with the Labour Department, Uttar Pradesh

The Indian Council of Industrial Management (ICIM), in association with Legal IPL, Utthan Samiti, NAEC, and Labour Law Reporter, hosted a pivotal seminar at Radisson MBD Hotel, Noida, aimed at enhancing awareness and compliance regarding First Aid Training, Prevention of Sexual Harassment (PoSH), and the upcoming New Labour Code

The program was inaugurated by Dr. Mahesh Sharma, Hon’ble Member of Parliament, who emphasized the necessity of organizing such awareness sessions regularly across industries. The ceremonial lamp lighting marked the beginning of this impactful event.

Dr. B.P. Bashisht from St. John Ambulance conducted a hands-on training session for factory owners and HR professionals, demonstrating essential techniques to handle medical emergencies in the workplace. The training underlined the critical need for emergency preparedness to save lives and ensure workplace safety under the Factories Act.

Legal Provisions on Workplace Harassment

Supreme Court Advocate S.K. Gupta provided a detailed legal perspective on the PoSH Act. He informed participants that:

  • Every company with 10 or more employees, regardless of the presence of women, must form an Internal Complaints Committee (ICC).
  • Failure to constitute an ICC invites a fine of Rs. 50,000, which doubles on a repeat offence.
  • On the third offence, the District Magistrate has the authority to revoke the company's license.

Mr. Gupta also explained a crucial clause in the new labour code: employees will now be able to file harassment cases directly in court, bypassing the Labour Commissioner's office—a major step toward empowering workers and ensuring workplace justice.

Yazat Kumar, Special Editor, Labour Law Reporter, led an insightful session on Industrial Relations and the structural changes in the New Labour Code. His presentation highlighted the code’s far-reaching implications on HR policies, compliance, and dispute redressal mechanisms.

Ms. Richa Aniruddh, acclaimed journalist and anchor, addressed the deeper societal implications of workplace harassment. She emphasized the importance of inculcating values at the family level and urged for mass awareness about PoSH laws to transform workplace culture nationwide.

Mr. Lalit Thukral, Chairman, NAEC, reaffirmed the need for regular training programs to promote legal awareness among company owners, helping them avoid unintentional non-compliance.

Mr. Satendra Singh, CMD of Legal IPL and State President of the Law of Labour Advisors Association (UP), stressed ICIM’s mission to guide industries in navigating critical regulatory frameworks. He reiterated that compliance with PoSH laws is not optional, and the consequences of negligence are serious and escalating.
